1 Contract

1.1 These general conditions of contract govern the contractual relationship between you and Tours in Bordeaux in respect of guided tours organised by us.

1.2 A contract is concluded once Tours in Bordeaux has accepted a booking you have made in writing (letter, email or via the internet) or by telephone.

2 Tours in Bordeaux (TIB)

2.1 Tours in Bordeaux is the trading name for the services offered by Marc O`Laimhin

2.2 Tours in Bordeaux is based at: 1 Rue Chabrely, Bordeaux, 33100

2.3 Marc O`Laimhin trades under the French ‘auto-entrepreneur’ scheme and pay taxes in France.

2.4 Services offered by Tours in Bordeaux are subject to French and European law. Any disputes arising from the provision of these services will be dealt with under French law.

3 Terms of payment

3.1 – The price is payable upfront, in full on the day of booking. The excursion is confirmed once 100% of the payment due is completed, unless expressly agreed by contract.

3.5 We reserve the right to change prices without notice in response to tax changes, additional costs or other operational reasons until and unless a tour is paid in full.

By submitting your payment for any tour, including all activities and attractions, you are accepting these Terms and Conditions in their entirety.

4 Cancellation and refunds

Cancellations, in full or part of the initial reservation, must be sent by email to the following address: info@toursinbordeaux.com

TIB grants itself the right to cancel if the number of people does not reach a minimum of 2 people.

Pursuant to the provisions of article L.121-20-4 of the Consumer Code, none of the services offered by the TIB is subject to the right of withdrawal provided for in articles L.121-20 et seq. of the French Consumer Code. Consequently, any cancellation or modification made by the customer before departure entails the following conditions:

  • 100% refund more than 7 days before departure;
  • 0% refund less than 7 days before departure or if no show on the day of departure;

5 No show / late arrival

5.1 The maximum waiting time of the guides is 15 minutes. In the event of a late arrival the duration of the tour will be reduced accordingly. After this time it will be assumed you will not be turning up for your tour.

5.2 If the client for the booked tour does not arrive then TIB will:

i. Make no refund

and reserves the right to:

ii. Levy a cancellation fee amounting to the balance of the tour price.

6 Programme alterations or cancellation of a tour by TIB

6.1 Tour programmes may be altered in unforeseeable circumstances. TIB will do all it can to offer alternative, equally satisfactory arrangements or another solution in such cases.

6.2 TIB is entitled to cancel tours in cases of force majeure (e.g. natural catastrophes, unrest, strikes) or in the event of government action, accidents, technical defects, illness, etc. Amounts already paid to TIB will be reimbursed but no compensation or out of pocket expenses will be paid.

7 Participation

7.1 Our exclusive tours are organised for up to a maximum eight guests. Clients who book one or two places should be aware that additional guests may join your group.

7.2 For the benefit of everyone TIB reserves the right to accept or reject any tour participant and to remove any client whose conduct is deemed incompatible with the interests of other clients, the public, suppliers or staff. TIB will not refund or cover any cost or expenses incurred for termination of tour arrangements due to unacceptable behaviour.

8. Travellers Who Need Special Assistance on Tours :

You must report any disability requiring special attention while on tour to TIB at the time the reservation is made. TIB will make reasonable attempts to accommodate the special needs of disabled travellers, but is not responsible in the event it is unable to do so nor responsible for any denial of services by carriers, hotels, restaurants, or other independent suppliers. TIB cannot provide individual assistance to clients for walking, dining, getting on and off vehicles, or other personal needs. TIB strongly recommends a qualified and physically able companion must accompany travellers who need such assistance. All travellers with TIB  are subject to the participation clause above.

9 Liability

TIB co-ordinates and arranges the numerous and various services of sub-contractors and vendors before and during a tour. This includes restaurants, activity providers and the owners of vineyards, chateaux ,gardens and other attractions visited. Any and all persons or companies engaged in conducting such support services are NOT employees of TIB. Therefore, TIB assumes no liability whatsoever for any loss or accident, loss or damage of personal property, delays, inconveniences, expenses of any kind or injury to the persons traveling on the tour. Additionally, TIB is not responsible for the default or negligence caused by any person or company engaged in providing any service for a tour, or by any strike, work stoppage, acts of Providence, weather or other events beyond our control. TIB reserves the right to cancel or alter any tour when circumstances demand or require.

10 Insurance

TIB has taken out a professional liability insurance contract covering the consequences of its professional civil liability under the conditions provided for by the texts in effect. This includes physical injury, material and immaterial damage.

We recommend all customers to purchase their own travel insurance and civil liability insurance
